Residence Agreement

In consideration of the mutual covenants contained herein, TRINITY COLLEGE (the “College”) and the undersigned (the “Resident”) agree as follows:

1. Occupancy Conditions

  1. The College grants to the Resident a license to use and occupy a room (the “Room”) in the Residences located at 6 Hoskin Avenue or 44 Devonshire Place, and respectively known as ߲Ƶ Residence or St. Hilda’s College Residence (the “Residences”) for a period (the “Occupancy Period”) commencing on the official move-in date (Sunday, August 25, 2024 for newly admitted first-year students registered for and attending Orientation and Monday, September 2, 2024 for returning students) and ending forty-eight (48) hours after the Resident’s final spring examination/assessment or at 12:00 (noon) on Thursday, May 1, 2025 whichever is the earlier date (the “Vacating Date”), unless terminated earlier pursuant to the provisions of this Agreement.
  2. Residents may request to stay in residence beyond 48 hours after their final exam; however, approval is subject to availability and circumstances. Additional charges may apply.
  3. The Residences are closed for the December Winter Break. All residents are expected to vacate their room no later than 48 hours after their final fall exam or by 12:00 (noon) on Sunday, December 22, 2024, whichever date is earlier. The residences will reopen on Sunday January 5, 2024 at 8:00 am, EST. During this time, the residences will not be open and as such, students will not be permitted to stay in residence for any reason. Staff in the Office of the Dean of Students are available to advise students about alternative housing options for the winter break, however, the responsibility for all aspects of deciding upon, securing and payment for accommodations during this time are the responsibility of the individual student.
  4. If a Newly Admitted Student Resident, defined as a student who did not attend ߲Ƶ the previous year, does not take possession of, and occupy, the Room by 11:59 pm Sunday, August 25, 2024, the Room license is automatically forfeited and cancelled and the student will be liable for both residence deposits #1 ($1000) and #2 ($1000). The College may then license the Room to another resident forthwith, without notice to the Resident.
  5. If a Returning Student Resident, defined as a student who was admitted to and attended ߲Ƶ in any year prior to the current year, does not take possession of, and occupy, the Room by 11:59 pm Monday, September 2, 2025, the Room license is automatically forfeited and cancelled and the student will be liable for both residence deposits #1 ($1000) and #2 ($1000). The College may then license the Room to another resident forthwith, without notice to the Resident.
  6. If after accepting an offer of residence a student (newly admitted or returning) decides that they no longer wish to live in residence they are encouraged to notify us immediately. Please refer to section 10.b. for more information regarding penalties for early residence withdrawal.

2. Eligibility

Only full-time University of Toronto students who are enrolled in a minimum of 3.0 FCEs, with a minimum of 3 courses in each of the Fall and Winter semesters, or comparable course load in a professional faculty or Faculty of Divinity, in good academic standing (minimum annual grade point average of 1.50+) and demonstrate progression in their academic program are eligible to reside in ߲Ƶ Residences unless alternate arrangements have been approved in writing by the Dean. Residents who withdraw from the University or drop below full-time status in either the Fall or Winter semesters, are required to inform the Office of the Dean of Students immediately. The College reserves the right to check the academic status of students to confirm their eligibility for residence as required.

3. Room Assignment

The Room and room type shall be assigned to the Resident by the Dean of Students (the “Dean”), or the Dean’s designate.

߲Ƶ reserves the right, without prior notice and at any point during the Contract term, to alter roommate assignments, accommodation placements, and/or consolidate vacancies, potentially necessitating a relocation from one accommodation to another. This may include moving a residence student to a different area, floor, building, or room. Furthermore, the College, at its absolute discretion, reserves the right to provide the option of converting double occupancy rooms into single rooms, adjusting maximum occupancy limits. In either scenario, a rate change, determined by the College, may be applicable.

4. Residence Fees

The Resident will pay an occupancy fee for the assigned room type and the choice of meal plan. All residents are required to purchase a meal plan as outlined on the ߲Ƶ Residence Fees webpage. The website also represents the portions due on the stated dates. The amount due will be the stated amounts minus any credits that may have already been applied. Any balance due must be received in full by the College or University by the dates stated in order to avoid the accrual of service charges on outstanding fees.

Please note that if Deposit #2 is not received by the deadline communicated to students, it will be recognized as a forfeiture of the Residence Room and of Deposit #1, and the Room will be reallocated to the next eligible student on the waiting list.

  • Email notices will be sent to those with outstanding account balances using the University’s UTmail+ email service; please ensure that you activate your UTmail+ email address.

5. College Environment

It is understood by the Resident that the residence facilities of the College are intended to promote a harassment-free environment and to enhance the academic and intellectual development of its students, their personal growth and their involvement in campus life and that, accordingly, the atmosphere, environment and behaviour in the Residences shall be conducive to, and consistent with, the achievement of these purposes.

To foster safe and welcoming residence communities, all students living in residence are expected to complete a mandatory online sexual violence education and prevention training module (the “Module”).

  1. Completion before move-in: As a condition of living in residence, students are expected to complete the Module prior to moving into the Residence.
  2. If the Resident is unable to complete the Module prior to move-in, the Resident will be permitted to move into the Residence on the condition that the Resident completes the Module within 14 days of their move-in date.
  3. Termination: The University reserves the right to terminate the Occupancy Agreement if the Resident does not comply with this requirement and upon exercising this right, the Resident will be required to vacate the Residence.

Additional information: Questions or concerns about the Module may be directed to the Manager of Residence Operations. The University may consider requests for an exemption to the requirement, in its sole discretion, provided that the request is made by the Resident to The Manager of Residence Operations. Exemption requests should be made as soon as practicable for the Resident but no later than 3 days prior to move-in date in order to provide the University with sufficient opportunity to review the request and to discuss with the Resident, if necessary

6. Responsibilities of the College

The College will:

  1. provide the Resident with the furnishings listed in Schedule “A” until the Vacating Date; and
  2. maintain the Room and the Residences in a reasonable state of repair and fit for habitation

7. Responsibilities of the Resident

  1. The Resident will:
      1. comply fully with the ߲Ƶ Community Standards, the , the , the ߲Ƶ Dining Hall Policy, the ߲Ƶ Alcohol Policy, the , the (PDF), the ߲Ƶ Residence Admission Policy, and the ߲Ƶ Episkopon Policy.
      2. receive one key for the Room and one key for admission to the Residences and one mailbox key (herein referred to as “keys”). The keys shall be returned by the Resident to the College on or before the Vacating Date. The Resident will not lend, nor duplicate, nor permit duplication of, nor be in possession of a duplicate of, any of the keys. If the Resident loses their keys, or fails to return them on the Vacating Date, the cost of replacing the keys will be billed to the Resident.
      3. maintain the Room in a clean and hygienic condition and will not allow any refuse, garbage or other objectionable material to accumulate in or about the Room or the Residences;
      4. comply with the ߲Ƶ Residence Network (ResNet) Rules and Policy.
  2. The Resident will not:
      1. assign this agreement or sub-license (e.g. Airbnb) the Room or any part thereof to any other person or otherwise part with the possession or occupation of the Room;
      2. paint or decorate the Room or Room Door or any wall, ceiling or surface of the Residences without the consent of the Dean;
      3. deface any wall, ceiling or surface of the Residences, including the windows, or damage the Residences or its furnishings or permit their guests or invitees to do so;
      4. under any circumstances tamper with or change the lock, or add a lock, locks or other security devices to the door of the Room;
      5. make any alterations to the structure of the Room or affix anything to the walls or ceiling thereof without the prior consent of the Dean;
      6. bring any external furniture into the Room, or remove original furniture from the Room;
      7. keep any devices in the Room that are not Ontario Electrical Safety Code approved. Such items can be removed from any Room as a potential fire hazard;
      8. keep or use a waterbed, open element (such as a hot plate, toaster etc.) or heating equipment (such as a space heater) in the Room, or use any device that might overload the electrical circuits (more information is available on the Frequently Asked Questions page of our website) ;
      9. tamper with or in any way interfere with the operation of any fire detecting or smoke detecting equipment for any reason;
      10. store, prepare, or consume “self-heating instant hot pot” meals in the Residences;
      11. keep any firearms, ammunition, air guns/rifles, fireworks, prohibited weapons, offensive weapons, slingshots, explosives, illicit narcotics and drugs, animals, reptiles, birds, fish or insect in the Room or in the Residences.
      12. engage in any behavior that disrupts the College’s ability to effectively allocate resources and manage residence operations.
      13. behave in a manner that will unreasonably disturb, annoy or interfere with, the use or enjoyment of the Residences by the other residents, or permit anything to be done or kept in the Residences which will obstruct or interfere with the enjoyment or rights of the other residents; or
      14. commit or permit an illegal act to be committed in the Residences.

8. Entry by College Staff

The Residence Staff, which include, but are not limited to the Dean or the Dean’s designate, Dons and Facilities staff shall be permitted to enter the Room at any time, and without notice, in the event of an emergency or perceived emergency, or a disturbance or breach or suspected breach of the ߲Ƶ Community Standards or other College policy, or in order to examine the state of the Room, including the state of sanitation, safety and repair thereof, and to make such repairs, changes or improvements to the Room and its furnishings as the College may deem necessary or desirable.

9. Termination by the College

  1. The College may at its option terminate this license upon the happening of any of the following events:
    1. non-payment by the Resident of any amount due to the College or University;
    2. breach by the Resident of any other provision of this agreement or the Rules and Regulations as published from time to time; or
    3. any event whereby the Resident ceases to be a registered student with a full-time enrollment status at the University of Toronto, including but not limited to the suspension or expulsion of the Resident from studies during the academic session.
    4. in accordance with section 17.
  1. In the event that the College exercises its option to terminate this license, the College or its designated official shall give written notice of such termination to the Resident, which shall specify the effective date of the termination, which shall not be less than three (3) days following the giving of the notice (the “Effective Date of Termination”). The notice may be hand delivered to the Room or affixed to the door of the Room, addressed to the Resident.
  2. Notwithstanding paragraph (b), under exceptional circumstances, including the occurrence of an “Emergency” as defined in Section 17, the College reserves the right, to be exercised by the Dean acting reasonably, to give written notice of termination of this license not less than 24 hours before the Effective Date of Termination.
  3. Notwithstanding the early termination of this license, the Resident shall at the option of the College be liable for payment of the full amount of the occupancy fee, whether or not the room is re-occupied or the Residences are filled.

10. Termination by the Resident

Students are admitted to residence on the understanding that they will remain in residence for the full Occupancy Period, which is the entire Fall and Winter Academic semesters. In the event that the Resident elects to withdraw from the Residences or from their program of study during the Occupancy Period, he/she will be required to submit a written Notice of Residence Withdrawal prior to the move-out date.

  1. Students who cancel their application or withdraw from residence will be subject to the following:

    • The “notice date” is the date upon which the request to cancel and/or withdraw is received.
    • The “vacating date” is the date upon which the resident moves out of residence and returns keys.
  2. Students who withdraw from the University will vacate the premises within 48 hours of the date upon which they cease to hold full-time academic status unless alternate arrangements are approved by the Dean of Students.
  3. Students who vacate their residence space without following proper procedures, including submitting the Notice of Residence Withdrawal and returning keys, will continue to be billed until such time as a proper check-out has taken place.
  4. All students, including those who withdraw from residence for academic reasons, are subject to the withdrawal penalties as outlined above.
  5. If applicable, students who must fulfill the requirements of Mandatory Quarantine as per the Government of Canada, contract dates and residence fees will not be adjusted.
  6. The above schedule of fees and amounts due will remain the same in the event that the University of Toronto makes changes to the mode of class delivery (i.e. in-person class delivery to online class delivery).

11. Residential Tenancy Act Exempt

Please note that a number of provisions of the Residential Tenancies Act do not apply to residents of the College in regard to their occupation at the College.

12. Pest Outbreaks

Residential buildings are occasionally subject to pest outbreaks, including but not limited to, bedbugs. If a pest outbreak is suspected, residents are required to immediately contact the Welcome Desk or the Office of the Dean of Students, so an inspection can be arranged. If the presence of pests is confirmed, residents will be required to actively participate in the treatment by following the directives of the College and/or professional Pest Control workers. To reduce the likelihood of spreading pests to unaffected areas, residents will not be relocated to a new room. No refund or reduction of fees will be issued to those who are inconvenienced by pest inspection or remediation processes.

13. Construction and Renovation 

߲Ƶ is engaged in the construction of the Lawson Centre for Sustainability and renovation projects across residence buildings. Although the College will take measures to minimize the impact on the community, there may be noise, dust, and disruption to services while these are underway. Efforts will be made to minimize any disruption caused; however, the College shall not be held liable for the above and there will be no reduction in fees, compensation, or remediation that will be offered for any direct or indirect loss, inconvenience, or discomfort experienced throughout the occupancy.

14. Liability

The College shall not be liable to the Resident for any damage to, loss, or theft of personal property or for personal injury, including death, on the Residences property save where the same is caused by the willful or negligent act or omission of the College or those for whom the College is in law responsible. The Resident will indemnify the College and save it harmless from any and all liability in respect of any injury, loss or damage occasioned by any act or omission of the Resident, their guests, agents or invitees.

15. Insurance

The Resident is required to have adequate insurance to cover any deliberate or accidental damage that they might cause to the Residences or other residents belongings. The College reserves the right to seek restitution for any damages caused by the Resident.

16. No Reduction of Fees

It is agreed that there be no reduction of occupancy fees or any other compensation for, or on account of, any loss, damage, inconvenience or discomfort arising from the interruption or curtailment, however caused, of any accommodation, facility or service agreed to be furnished by the College.

17. Emergencies and other unavoidable events

  1. An “Emergency” means a health emergency or other unavoidable event which is beyond the reasonable control of the College, which results in a situation in which the College determines in its sole discretion, based on advice from a medical professional, or a directive, bulletin, notice or other form of communication, order or legislation from a public health authority or other authority having jurisdiction, or other information or advice deemed relevant by the University (“Directives”), that a Resident, employees of the College or other persons or invitees, are or may be exposed to imminent danger from a dangerous condition or situation, damage to the Residences, disease, virus or other biological or physical agents that may be detrimental to human health, while in the Residences.
  2. If an Emergency exists, the College may amend, supplement or otherwise enforce any rules or regulations in existence, may impose additional rules and regulations, and may impose restrictions to mitigate or minimize the effects of the Emergency.  Without limiting the generality of the foregoing:
    1. during an Emergency, the College shall be entitled to restrict or limit access to Residences to employees of the College only, and/or to prohibit entry by a Resident, visitors or invitees for a reasonable period of time during such an event;
    2. notwithstanding that the College may have entered into an Occupancy Agreement with a Resident, the University shall have the right during an Emergency, to terminate such agreements prior to the commencement of the Occupancy Period, in order to comply with Directives or where the College determines that it will not be safe to operate Residences for a Fall and/or Winter semester, and the College shall have no liability to a Resident as a result of such termination;
    3. the College shall be entitled during an Emergency to close all or any part of the Residences if it determines that it is not safe to continue to operate the Residences or certain parts thereof, in which case a Resident shall vacate the Room they occupy in accordance with the reasonable requirements of the College;
    4.  the College shall be entitled, during such time as there is an Emergency to require all Residents to comply with reasonable measures imposed in respect thereof by the College, including health screening, the use of hand washing and other sanitation products directly related to the management of the health threat, attendance at mandatory training sessions, and the use of additional protective clothing by all Residents such as protective barriers, gloves and masks; and
    5. during an Emergency, the College shall also be entitled to specify specific modes of entry and exit from and to the Residences for Residents generally or Residents who may have a heightened risk of either exposure to a health threat or a heightened risk of transfer of unhealthy condition to other Residents, invitees or visitors in the Residences.
  3. Where an Emergency or any other restrictive governmental laws or regulations, fire, damage, or other unavoidable event which is beyond the control of the College, results in the closure of the Residences during the Occupancy Period, the College, in its sole and absolute discretion shall determine what, if any, fees shall be refunded to the Resident, having regard to the length of the closure, the nature of the event causing the closure and such other factors as the College deems appropriate in the circumstances.

18. It is understood by indicating agreement with these terms and conditions as part of the residence application process, the Resident is subject to all the terms and conditions herein.

SCHEDULE “A”

The College will supply the resident with the following furnishings until the Vacating Date:

  • Curtains or Blinds
  • Garbage and Recycling Cans
  • Internet Connection
  • Smoke Detector and Battery
  • Note: Some, but not all, rooms are equipped with local phone service.
APPENDIX A - KEEPING YOUR TRINITY RESIDENCE ROOM CLEAN

Students are responsible for keeping their residence rooms clean and tidy. Trinity has resources available to you to help you to maintain a clean room!

Why should I keep my space clean?

  • Clean and tidy residence rooms mean that pests that can be more common in shared living spaces like apartment buildings and university residences don’t have any reason to make a home in your space.
  • Any smells or issues that can come from an untidy or unclean space are often disruptive for a residence community like the one you’re living in. If your room becomes a community issue, further steps to address the unclean space will need to be taken such as cleaning charges or follow up with College staff.
  • Distractions to students such as an untidy space have been shown to disrupt projects like academic work.

Trinity will provide you with a vacuum cleaner and some basic cleaning supplies, although you are encouraged to bring your own preferred cleaning supplies and materials. See the Welcome Desk for details on how to access vacuums and cleaning supplies.

Safety tips for cleaning your space:

  • Do not mix store-bought cleaning products together! Mixing products can create toxic gas and cause harm.
  • Using the wrong cleaner on a delicate surface – Many of today’s counter-tops, floors, and appliances require specialty cleaners. Even plain old soap and water is a problem on some surfaces. Be sure to read the labels on your products to ensure against damage!
  • Abrasive cleaners or scrubbers – There are plenty of products specially designed for heavy duty tasks. Use of abrasive cleaners (e.g. powder cleaners) and metal scouring pads will only damage the surfaces leading to future maintenance and cleaning problems.
